Brabenec bill targets fentanyl and its spinoffs

A new bill sponsored by Assemblyman Karl Brabenec would zero in on a deadly piece of the ongoing opioid epidemic by creating a new criminal charge specifically for fentanyl – the powerful drug that has played a part in many overdose deaths – and for fentanyl spinoffs known as analogues that are manufactured to try to sidestep narcotics laws.

The bill would make it a class E felony to make, sell or possess fentanyl or any of its derivatives.

“The heroin and opioid epidemic is sweeping the country, and the Hudson Valley is certainly not immune from its horrors,” Brabenec, a Deerpark Republican, said in a press release. “Dealers and distributors are lacing heroin, which is deadly enough, with fentanyl and its derivatives in order to increase profits and make a stronger, more potent drug.”

The Orange County Legislature has twice passed a resolution urging state lawmakers to pass legislation to make fentanyl analogues illegal.
